1. Introduction

These Terms and Conditions ("Terms") govern your use of the services provided by Fine Landscape LTD ("Fine Landscaping", "we", "us", or "our"), a company registered in England and Wales with company number 13757648, with registered address at 31 Tylecroft Rd, Norbury, London SW16 4BL.

By engaging our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

2. Services

Fine Landscaping provides landscaping, garden design, driveway installation, patio construction, fencing, decking, and related outdoor improvement services across South London and Surrey.

All services are subject to:

• An initial consultation and site survey
• A written quotation detailing the scope of work
• Agreement on project specifications and materials
• Acceptance of the quotation by the customer

3. Quotations

All quotations provided by Fine Landscaping are:

• Free of charge and without obligation
• Valid for 30 days from the date of issue unless otherwise stated
• Based on the information provided during the site survey
• Subject to change if site conditions differ from those observed

A quotation becomes a binding contract once accepted by the customer in writing (including email) and confirmed by Fine Landscaping.

4. Payment Terms

4.1 No Deposit Required

Fine Landscaping does not require any deposit before commencing work. This demonstrates our confidence in our workmanship and commitment to customer satisfaction.

4.2 Payment Schedule

Payment is due as follows:

• For projects under £5,000: Full payment upon completion
• For projects over £5,000: Stage payments may be agreed, with the final payment due upon completion

4.3 Payment Methods

We accept payment by:

• Bank transfer (BACS)
• Debit or credit card
• Cash

4.4 Late Payment

Invoices are payable within 7 days of completion. Late payments may incur interest at 8% above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

5. Workmanship Guarantee

Fine Landscaping provides a comprehensive 10-year workmanship guarantee on all completed projects. This guarantee covers:

• Defects in workmanship
• Structural issues arising from installation
• Settlement or movement caused by inadequate preparation

The guarantee does not cover:

• Normal wear and tear
• Damage caused by third parties
• Damage resulting from misuse or neglect
• Natural weathering of materials
• Issues arising from ground movement or subsidence
• Manufacturer defects (covered by manufacturer's warranty)

6. Materials

Unless otherwise agreed:

• All materials are supplied by Fine Landscaping
• Materials remain our property until full payment is received
• We source materials from reputable UK suppliers
• Any customer-supplied materials are used at the customer's risk

7. Project Timeline

Estimated project timelines are provided in good faith but are not guaranteed. Delays may occur due to:

• Adverse weather conditions
• Unforeseen site conditions
• Material supply issues
• Changes requested by the customer

We will keep you informed of any significant delays and work to minimise disruption.

8. Customer Responsibilities

The customer agrees to:

• Provide accurate information about the property and any known issues
• Ensure access to the work area as required
• Obtain any necessary planning permissions or building regulations approval
• Inform us of any underground utilities or services
• Secure pets and valuables during the project
• Make reasonable provisions for parking and material storage

9. Cancellation

9.1 Before Work Commences

You may cancel at any time before work commences without penalty.

9.2 After Work Commences

If you wish to cancel after work has started, you will be liable for:

• The cost of all work completed to date
• The cost of materials ordered or delivered
• Any reasonable costs incurred by Fine Landscaping

10. Variations

Any changes to the agreed scope of work must be confirmed in writing. Variations may affect the project cost and timeline, and will be quoted separately before proceeding.

11. Insurance

Fine Landscaping maintains comprehensive insurance including:

• Public liability insurance up to £5,000,000
• Employer's liability insurance
• Professional indemnity insurance

Certificates of insurance are available upon request.

12. Health and Safety

We comply with all relevant health and safety legislation. We request that customers and their families maintain a safe distance from the work area during construction.

13. Complaints

• We are committed to resolving any issues fairly and promptly

14. Limitation of Liability

Our liability is limited to the contract value of the project. We are not liable for:

• Indirect or consequential losses
• Loss of profit or revenue
• Damage to items not covered by the contract

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or for fraud.

15. Data Protection

We collect and process personal data in accordance with our Privacy Policy and applicable data protection legislation including the UK GDPR.

16. Intellectual Property

All designs, drawings, and specifications created by Fine Landscaping remain our intellectual property until the project is completed and paid for in full.

17. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
